Terms and Conditions
These Terms and Conditions form the basis of the contract between our client (customer) and Celebrity Cakes Ltd. These Terms, your order requirements received via the website, social media, or contained in the QUOTATION and then INVOICE, are considered by Celebrity Cakes Ltd. to set out the whole agreement between you and us for the sale of cakes and confections.
It is your responsibility to check that our interpretation of your requirements is fully detailed in the INVOICE and that they are complete and accurate, as this is the document we work to when completing your order. All of our products are made especially for you—no stock is carried. Some products are available by mail order, and some are hand-delivered or collected by prior agreement. All Products sold by Celebrity Cakes Ltd. are subject to the following Terms and Conditions.
DEFINITIONS
-
The “Seller” is Celebrity Cakes Ltd.
-
The “Client” means the person who buys the goods.
-
“Goods” are the items to be supplied by Celebrity Cakes Ltd. as detailed on the invoice.
GENERAL
All of our products are bespoke and made to order—no stock is carried. By ordering from Celebrity Cakes Ltd. you agree to be legally bound by these Terms and Conditions which may be updated at any time in writing or on the website.
INGREDIENTS, ALLERGENS & CLINICAL SAFETY
All orders are subject to a mandatory Allergen Declaration. It is the client’s responsibility to provide accurate dietary information during the enquiry phase. Because we operate a Clinical Standard of production, any failure to disclose allergies or changes to dietary requirements may result in the cancellation of your order without refund, as it compromises our food safety protocols and cross-contamination management.
All cakes, fillings, and icings may contain or come into contact with soy, dairy, nuts, or other allergens excluding gluten. All products and our kitchen/studio are entirely gluten-free and managed to be safe for those with coeliac disease. We hold Coeliac UK training, have over 30 years in managing a gluten-free diet, and maintain strict gluten-free procedures.
If you have any allergies or intolerances in addition to gluten, you must inform Celebrity Cakes Ltd. before confirming your booking. It is your responsibility to inform your guests. We can offer nut-free cakes for intolerances by prior agreement, but products are not suitable for nut or peanut allergy sufferers as our kitchen handles nuts. Unless agreed in writing, all special dietary products are for intolerances only, not allergies.
All products are best eaten on the celebration day. If an ingredient is out of stock, a suitable substitution will be made without compromising dietary safety.
ORDERS
We prefer at least 14 days’ notice for all orders (longer for wedding cakes and large events), but may accept short-notice orders where possible. For orders from a picture or photo, our cakes will always be an interpretation, not a copy; we cannot reproduce the work of another cake designer exactly.
PAYMENT, BOOKING FEES & THE DATE RETAINER
A 25% non-refundable booking fee is required to confirm and hold your date for all orders. This fee covers the administrative costs of your safety triage, the specialist consultation process, and the exclusive reservation of your date in our clinical production calendar. As this represents work already performed and the loss of availability to other clients, it is non-refundable.
The remaining balance is due 5 weeks prior to agreed collection or delivery (as detailed on your invoice). Orders placed with less than 5 weeks’ notice must be paid in full at the time of order. Orders placed with under 2 weeks’ notice must be paid in full within 24 hours of invoice.
For weddings and dessert tables, a Save the Date reservation is available (£150, or a lower fee if 25% of your total is less than £150). Final design and flavour profiles can be confirmed closer to the event, but the reservation ensures your slot in our managed production workflow is secured.
ORDER CANCELLATION & THE “BESPOKE” EXEMPTION
All Celebrity Cakes products are bespoke, made to order, and perishable. Under UK Consumer Contracts Regulations 2013/2014, bespoke items are exempt from standard “cooling-off” periods. Orders cannot be cancelled or refunded once work has begun or any custom elements (including specialist ingredients) have been sourced.
Refund & Postponement Policy Summary:
-
More than 90 days notice: Booking fee only.
-
90 days–1 month notice: Booking fee + 50% of remaining cost.
-
Less than 1 month notice: Full contract cost due.
If we must cancel due to unforeseen circumstances, you will be offered a suitable alternative or full refund.
DESIGN, ALTERATIONS & QUOTES
Alterations must be requested in writing at the earliest possible date. Where possible, we will accommodate your requests, but changes may affect cost/time. We reserve the right to alter the design if the original request uses unsafe materials (such as toxic flowers or non-food-safe metallics). Quotes are valid for 30 days and do not constitute a booking.
DELIVERY, COLLECTION & HANDOVER
Upon collection or delivery, a Professional Handover Note will be provided, including a tally of non-edible components (the "Safety Count"). Signed acceptance is confirmation that the product has been received in optimal condition and the legal "Chain of Care" transfers to you.
-
Venue/Hand Deliveries: Require a signed note on receipt.
-
Postal Deliveries: Notify us within 48 hours (with photos) of any damage.
-
Liability: Once a bespoke order leaves our possession (post-signed handover), we are not liable for any damage caused by handling, transport, weather, or event circumstances.
STORAGE & AFTERCARE
Celebrity Cakes cannot be held liable for structural or aesthetic damage caused by incorrect storage. Unless otherwise stated, our cakes are designed for Ambient Storage and must not be refrigerated. Store your cake at room temperature away from heat, direct light, and moisture. Specific shelf-life instructions are provided with your order.
NON-EDIBLE ELEMENTS
Our cakes contain internal structural supports (dowels) and may contain decorative wires or picks as standard practice. These will be clearly indicated on your Handover Note and must be removed before serving.
RETURNS & COMPLAINTS
Returns are only accepted if your item is found to be incorrect, deeply flawed, or damaged (excluding minor handcrafted variations or damage post-handover).
-
Notification: Issues must be reported within 24 hours of receipt with clear photos.
-
Assessment: Complaints regarding quality can only be considered if the cake has been stored as per our guidelines and has not been eaten or discarded before assessment. Once a cake has been consumed or the internal "Safety Count" has been disturbed, we cannot process complaints or compensation.
-
Liability: Our liability is limited to the value of the cake or element in question.
CONSULTATIONS, TASTINGS & STAND HIRE
Consultations are by appointment only. Video and Full Design Consultations are subject to current fees as per our bookings page. Stand hire requires a hiring fee and needs to be returned if stands are back undamaged within six working days.
INTELLECTUAL PROPERTY & JURISDICTION
All designs and images remain property of Celebrity Cakes Ltd. and may be used for marketing purposes. These Terms are governed by the laws of England and Wales.
